togeob REPRODUCED AT THE NATIONAL ARCHIVES Article 102 of the Constitution of Costa Rica reads as follows: Duties and Attributions of the Executive Power: To freely name and remove Secretaries of State and any employees of his dependency, and to call to exercise the Executive Power, during temporary absences, the Designate whom he may consider suitable. In the absence of such a call, the Designate indicated in the order of nomination will exercise the Executive Power. have learned through unofficial sources closely associated with the administration that the President had decided, when it appeared for a time that he might find it necessary to relinquish the powers of Chief Executive temporarily, to name his brother, the Third Designate, to exercise the powers of President. It would appear, however, that by the provisions of Section of Article 73 of the Constitution, the Presidency would pass to the First Designate in the event of the death of the President, to the exclusion of any Designate who might be exercising the powers of Chief Executive at such time.
In view of the omission in typing of part of one sentence on page three of my despatch No. 2696 of November 12, 1940, there are enclosed corrected copies with the request that they be used to replace page three of the despatch as originally received.
